Satellite and rocket company SpaceX on Thursday sued a US labor agency to block its case, accusing the firm of illegally dismissing workers who sent letters to its managers calling CEO Elon Musk an embarrassment and a distraction. The company claimed that the NLRB’s structure, which filed a complaint against it on Wednesday, violates the US Constitution’s guarantee of due process.
The National Labor Relations Board claimed that SpaceX violated labor law by dismissing eight workers after they signed a letter criticizing CEO Elon Musk. An administrative judge will preside over the case.
In its lawsuit, SpaceX claimed that the structure of the NLRB is unconstitutional, as it only allows administrative judges and board members to be removed for cause. The company also seeks to prevent the case from proceeding.
SpaceX used a similar strategy to prevent the Department of Justice from filing an administrative case against the company, which was related to its refusal to hire refugees and asylum seekers. An administrative case involving the company was placed on hold in November while it pursues its own legal action.
According to the judge, the US Constitution requires the president to appoint administrative judges. This is not the case with the current attorney general. The NLRB is also facing a lawsuit from a Starbucks worker who was opposed to the company’s plan to unionize the workers at a location in New York.
In October, a worker sued the NLRB after it rejected her bid to have the organization dissolved. The agency hasn’t responded to the case.
